Phoenix Retreat
By submitting payment for a Phoenix Retreat by Stellar Life Coaching, LLC you acknowledge that you have read, understand and agree to the following Terms and Conditions:
Liability
You understand that Stellar Life Coaching, LLC and all it’s employees, contractors and representatives are not medical or psychological professionals. If a situation arises where medical or psychological intervention is needed Stellar Life Coaching, LLC is ethically and legally bound to refer you to a mental health or medical professional or institution. Coaching is not to be used as a substitute for professional advice by legal, medical, financial, business, spiritual, or other qualified professionals. You are responsible to seek independent professional guidance when appropriate, you understand all decisions and any actions regarding these areas are your sole responsibility.
Confidentiality
All details and relationships shared during the Retreat are held in the strictest confidence. As a participant in this Retreat you may not share the identity, stories, or experiences of any other Retreat participant or instructor this includes in online or on social media platforms, without their expressed consent.
You understand as a participant in the Retreat, that you will have the strictest confidentiality, except when you express intent to harm yourself or others, Stellar Life Coaching, LLC and The Phoenix Retreat reserve the right to disclose information regarding illegal activity and threats to the appropriate authorities.
Individual Results and Responsibility
You are fully responsible for your own well-being during the Retreat, including your own choices and decisions. This Retreat is designed to facilitate the creation/development of personal, professional, or business goals and to develop and carry out a strategy/plan for achieving those goals. Deciding how to handle these issues and implement changes is exclusively your responsibility.
You understand that your commitment and follow through are paramount to the success of the coaching process. Therefore, The Phoenix Retreat, and Stellar Life Coaching, LLC cannot guarantee any results to be achieved. Although there are no guarantees on the outcomes from coaching, most people report significant progress on their goals and understanding of themselves.
Challenge by Choice
You understand that you are choosing to participate in a Retreat where you will be challenged emotionally and mentally, the content of the Retreat, the activities therein are designed to push you out of your comfort zone. Thus, your participation is key to getting results. You understand that you will not be forced to participate in activities you do not want to participate in, however, by not participating you understand you may not get the results you want. If you are challenged or pushed physically mentally or emotionally, it is by your own choice.
Drug and Alcohol Policy
You understand that there is a strict no drug or alcohol policy. Illegal drugs (whether under the laws of the United States or the Retreat destination) are not to be consumed or sold throughout the length of this Retreat. If you violate this policy, you understand you will be asked to leave the residence and no refund will be provided.
Discrimination and Derogatory Language
You understand that you will be a part of an international Retreat with a diverse group of women from different countries, races, nationalities, and sexual identities – in a country not of your own. You will be sensitive to cultural differences between us. You will be curious, open, and supportive regardless of their race, nationality, religion, gender identity, or sexual orientation. You understand if you use any discriminatory or derogatory language based on the forenamed classifications of any other participant, you will be asked to leave the residence and no refunds will be provided.
Technical Detox
To connect in real life, we need a technical and virtual detox. So we are asking everyone to unplug for the weekend. This means NO screens – no emails, texts, Facebook, Instagram, or any other social media. We are asking for no laptops or surfaces of any kind. Handwriting or creative artistic expression for your thoughts and feelings is what we are asking for.
All supplies and materials will be provided.
Image Release
You hereby grant to The Phoenix Retreat and Stellar Life Coaching, LLC (“photographer”), and their legal representatives and assigns, the irrevocable and unrestricted right to use and publish photographs and or video, of you, or in which you may be included, for editorial trade, advertising, and any other purpose and in any manner and medium; and to alter the same without restriction. You hereby release Photographer and his or her legal representatives and assigns from all claims and liability relating to said photographs and videos.
RELEASE AND WAIVER OF LIABILITY AND INDEMNITY AGREEMENT
You agree to assume the risks incidental to your participation in the Phoenix Retreat (which risks include, but are not limited to, physical injury, emotional injury or death) and on your behalf and on behalf of your heirs, assigns, executors and administrators, you agree to release and forever discharge the released parties defined below, of and from all liabilities, claims, actions, damages costs or expenses of any nature arising out of or in any way connected with your participation in the Phoenix Retreat activities. The released parties are: The Phoenix Retreat, Stellar Life Coaching, LLC its members, managers, contractors, employees, volunteers, agents, representatives, successors and assigns namely, but not exclusively, Kendra Davies, and Dina Filice (hereinafter “Releasees”).
IN FURTHER CONSIDERATION OF BEING PERMITTED TO PARTICIPATE IN THE PHOENIX RETREAT FOR ANY PURPOSE INCLUDING, BUT NOT LIMITED TO OBSERVATION OR USE OF FACILITIES OR EQUIPMENT, OR PARTICIPATION IN ANY OFF-SITE PROGRAM AFFILIATED WITH THE RETREAT, YOU HEREBY AGREES TO THE FOLLOWING:
YOU HEREBY RELEASE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE STELLAR LIFE COACHING, LLC, THE PHOENIX RETREAT, KENDRA DAVIES, DINA FILICE, ITS DIRECTORS, OFFICERS, CONTRACTORS, EMPLOYEES AND AGENTS (HEREINAFTER REFERRED TO AS “RELEASEES”) FROM ALL LIABILITY FOR ANY LOSS OR DAMAGE, AND ANY CLAIM OR DEMANDS THEREFOR ON ACCOUNT OF ANY AND ALL INJURY TO YOUR PERSON (INCLUDING DEATH) OR PROPERTY WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE WHILE YOU ARE IN, UPON, OR ABOUT THE PREMISES OR ANY FACILITIES OR EQUIPMENT THEREIN OR PARTICIPATING IN ANY PROGRAM AFFILIATED WITH THE RETREAT. THIS RELEASE BINDS YOU, YOUR PERSONAL REPRESENTATIVES, ASSIGNS, HEIRS, AND NEXT OF KIN.
YOU HEREBY AGREE TO INDEMNIFY AND SAVE AND HOLD HARMLESS THE RELEASEES AND EACH OF THEM FROM ANY LOSS, LIABILITY, DAMAGE OR COST THEY MAY INCUR DUE TO YOUR PRESENCE UPON OR ABOUT THE RETREAT PREMISES OR IN ANY WAY OBSERVING OR USING ANY FACILITIES OR EQUIPMENT OF THE RETREAT OR PARTICIPATING IN ANY PROGRAMS AFFILIATED WITH THE RETREAT WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE.
YOU HEREBY ASSUMES FULL RESPONSIBILITY FOR AND RISK OF BODILY INJURY, DEATH, OR PROPERTY DAMAGE TO YOU DUE TO THE NEGLIGENCE OF RELEASEES OR OTHERWISE WHILE IN, UPON OR ABOUT THE PREMISES OF THE RETREAT AND/OR WHILE USING THE PREMISES OR ANY FACILITIES OR EQUIPMENT THEREON OR PARTICIPATING IN ANY PROGRAM AFFILIATED WITH THE RETREAT.
YOU FURTHER EXPRESSLY AGREE THAT THE FOREGOING RELEASE, WAIVER AND INDEMNITY AGREEMENT IS INTENDED TO BE AS BROAD AND INCLUSIVE AS IS PERMITTED BY THE LAWS OF THE STATE OF FLORIDA AND THAT IF ANY PORTION THEREOF IS HELD INVALID, IT IS AGREED THAT THE BALANCE SHALL, NOTWITHSTANDING, CONTINUE IN FULL LEGAL FORCE AND EFFECT.
No Refunds or Cancellations
You understand that by registering for the Retreat, your spot is reserved and your accommodations are booked. If for any reason you cannot attend, you may gift your seat to someone else to come in your place. If you cancel with sufficient notice and at our sole discretion, we may attempt to sell your seat to another person and apply your payment to another Stellar Life Coaching service, workshop, or Retreat of your choice. NO CASH REFUNDS WILL BE MADE.
Force Majeure/Acceptance of Risk
You agree to accept the risk of cancellation or delay of the Retreat due to an unforeseen event such as acts of God, acts of governmental authorities, extraordinary weather conditions or other natural catastrophes, or any other cause, similar or dissimilar, beyond the reasonable control of Stellar Life Coaching, LLC. NO CASH REFUNDS WILL BE MADE.
Jurisdiction and Venue
You agree and consent to personal jurisdiction and venue of the state and federal courts located in Orange County, Florida for any lawsuit that arises from or relates to this Agreement.
Full Agreement
You agree that no oral representation, statement or inducement has been made to alter, amend, waive or contradict the provisions of these Terms and Conditions.
